These Terms & Conditions replace any prior agreements or arrangements you may have had with us. Blue retains the right to terminate these Terms or any services offered to you or even cease offering or denying access to the services at our discretion and for any reason.

We may periodically make amendments to the Terms & Conditions associated with our services, and any such changes will be effective once we post the updated Terms or policies on the relevant service platform. By continuing to access or use our services after any amendments, you expressly consent to be bound by the modified Terms.

Our commitment to these Terms of Service reflects our dedication to providing a seamless and reliable transportation experience.

Should you have any questions or concerns regarding these Terms & Conditions, we encourage you to contact our support team. We value your trust and remain committed to delivering a seamless and satisfactory user experience.

Suppose a complaint or conflict requires resolution, including an accident involving you and the Driver. In that case, we may provide the necessary information (including your contact information) to the concerned authorities.

2. Blue Platform: Making Convenient Transportation Possible

Blue is a technology-driven solution platform that empowers users of Blue’s mobile applications to arrange and schedule transportation quickly. Through the platform, users can connect with third-party providers who offer these services, all under arrangements with Blue or its affiliates.

Remember that Blue does not directly provide transportation or function as a transportation carrier is essential. Instead, all rides are provided by drivers working under the supervision of limousine companies or sponsored by them.

The Blue platform serves as a conduit for users, enabling them to access a vast network of drivers, who can fulfill their transportation. These drivers are unrelated to Blue but have agreed to provide their services through the platform.

By utilizing Blue’s platform, users benefit from the convenience and flexibility of arranging transportation on-demand while also availing themselves of a vast network of drivers. These Terms & Conditions allows Blue to offer a seamless experience while connecting users with reliable and verified service providers within their local communities.

Overall, Blue’s platform provides users with a convenient and reliable means of accessing transportation. By relying on a network of drivers, Blue ensures that users receive high-quality service that meets their transportation needs efficiently.

3. Blue Reliable Platform Definitions

To better define and clarify the key terms used with Blue’s contracts, Terms and Conditions, Privacy Policy and Platform, the following definitions are provided:

“Blue” “User app” is a technology-driven solution platform that empowers users of Blue’s mobile applications to arrange and schedule transportation quickly. Through the platform, users can connect with third-party providers who offer these services, all under arrangements with Blue or its affiliates.

“Blue Driver app” is the driver’s platform through which drivers can contact users to arrange and schedule transport requests they receive through this platform applications.

“Platforms and applications” are both driver and user platforms and applications:

“Personal information” the data and information generated about users and drivers.

“Users” or “You” refer to individuals who avail themselves of the services provided by the drivers.

“Driver” indicates the individual engaged as the vehicle’s operator, who provides the requested services to the customers.

“Driver” or “Drivers” refers to the person(s) acting as the operator(s) of the vehicle(s), who provide(s) the required services to customers and who is (are) affiliated with limousine companies or sponsored by them.

“Vehicles” are operated by drivers, referred to as “Drivers,” and are owned by limousine companies or sponsored by them.

“Use of Service” encompasses all activities related to users downloading the Company’s Mobile Application and any other actions associated with accessing and utilizing the services provided by Blue.

The term “Services” encompasses various offerings, including road-hailing services and pickup and drop services (booking), provided by the driver from and to locations per the user’s request.

“Territory” refers to the Estonia.

4. Enhancing Transportation Convenience with the Blue Platform

The Blue platform revolutionizes transportation convenience by allowing users to schedule ride-hailing services through its user-friendly mobile application. When drivers accept a booking for hailing, pickup, and drop-off services, Blue’s application promptly provides users with the driver’s details.

To ensure a smooth experience, Blue makes reasonable efforts to fulfill users’ booking requests by assigning drivers available near their location. Blue promptly shares the Driver’s primary name, contact information, picture, plate number, and estimated arrival time if a driver is available. However, please note that while Blue facilitates the booking process, the driver is ultimately responsible for delivering the final service. If a driver cannot fulfill a user’s request after accepting the ride, Blue will not be held liable.

Using the Blue platform, users declare that the information they provided is accurate and complete, and Blue is given permission to verify it. Users should download the correct application, visit the official website, and contact the proper support team to ensure a smooth experience. Blue cannot be held responsible if users download the wrong application, visit an incorrect website, or contact a false support team.

While utilizing the service, users agree to treat both Blue and the driver with respect and refrain from causing damage to the driver’s vehicle or engaging in any unlawful or abusive behavior. It is important to note that any materials on the Blue platform are not meant to be used as advice. Blue is not responsible for any problems or harm that might occur if someone decides to rely on these materials, whether directly or indirectly. In simpler terms, if the drivers and users use the information on the platform and encounter any issues, Blue is not responsible for them.

The Blue service is available only to individuals at least 18 years old to ensure user safety and compliance. Through our platform, users can effortlessly book rides and request transportation services. At the same time, drivers benefit from the support and resources offered by Blue, thereby expanding their customer base and enhancing their income.

It’s important to emphasize that Blue operates as an intermediary platform, facilitating connections and transactions between users and drivers affiliated with limousine companies or sponsored by them, thus ensuring a smooth and reliable experience for all parties involved.

5. Access and Usage Permit for the Blue Platform

Subject to the user’s compliance with the terms outlined in this T&C (Terms and Conditions), Blue grants the user a limited, non-exclusive, revocable, and non-transferable Permit. This Permit enables users to access and utilize the Blue Platform and any associated materials exclusively for personal, non-commercial use.

Accepting these terms allows the user to access and use the Blue Platform within the bounds specified in the Permit. It is essential to adhere to all terms and conditions to ensure continued access and usage of the platform.

This Permit is exclusively granted to the user and cannot be transferred or assigned to any third party without prior written consent from Blue. Additionally, this Permit may be revoked by Blue at any time should the user violate any of the terms outlined in this T&C.

The granted Permit allows users to access and use the Blue Platform for personal purposes, such as booking and utilizing transportation services. Commercial use of the platform, including any help to generate revenue or offer services to others, is strictly prohibited.

By accessing and utilizing the Blue Platform, the user acknowledges and agrees to abide by all applicable laws and regulations. Furthermore, any modifications, copying, distribution, or secondary use of the Blue Platform or associated materials without explicit authorization from Blue is strictly prohibited.

The user must be aware that this Permit does not grant any ownership or intellectual property rights related to the Blue Platform or its associated materials. All ownership and intellectual property rights remain the exclusive property of Blue.

In the event of a breach of the terms of this T&C, Blue reserves the right to terminate or suspend the user’s access to the Blue Platform without any prior notice or liability.

By continuing to access and use the Blue Platform, the user acknowledges and agrees to be bound by the terms and conditions outlined in this T&C. It is essential to review and understand these terms to ensure compliance and continued access to the Blue Platform.

6. Accessing Third-Party Services and Content: Acknowledgment and Disclaimer

When using the Services, it is possible to access third-party services and content, including advertisements, which are not controlled by Blue. The user acknowledges that different terms of use and privacy policies may apply when utilizing such third-party services and content. It is important to note that Blue does not endorse these third-party services and content. Therefore, it shall not be held responsible or liable for any products or services such third-party providers provide.

To access theBlue Platform, users can utilize applications developed for Apple iOS and Android. In such cases, Apple Inc, and their applicable international subsidiaries and affiliates act as third-party beneficiaries of this contract. Please note that while these entities are not direct parties to this contract, they are not responsible for the provision or support of the Blue Platform in any manner. Users who access the Blue Platform through these devices are subject to the terms and conditions outlined in the applicable third-party beneficiary’s service agreement.

Users need to acknowledge that Blue does not have control over the content and services provided by third-party entities, such as (Transaction costs, taxes, fees, or charges). Including third-party services and content within the Blue Platform does not imply any endorsement or responsibility on the part of Blue. Users are advised to review and understand the terms of service and privacy policies of any third-party services they access through the platform.

By utilizing the Blue Platform and accessing third-party services, users accept that Blue cannot be held accountable for the actions, products, or services of these third-party providers. The user is responsible for exercising caution and making informed decisions while interacting with third-party services or content accessed through the BluePlatform.

Users are encouraged to familiarize themselves with the terms and conditions of use and privacy policies set forth by these third-party entities, as they govern the user’s access to and use of their respective services.

7. Use of the Company Platform and Service 

Creating and maintaining an active personal Account is necessary to access the Company Platform. Please note the following requirements and responsibilities associated with managing your Account:
 
Age Requirements: You must be at least 18 to create an Account and access the Company Platform.
 
Accurate, Clean and Complete Information: When creating your Account, it is essential to provide accurate, complete, and up-to-date personal information. This includes your name, mobile phone number, and age. Email and pictures are optional. Users are also advised to refrain from entering profile information that displays obscenity or objectionable material in any form. Failure to comply and maintain accurate and complete Account information may result in losing access to the Company Platform.
 
Account Security: It is your responsibility to ensure the security and confidentiality of your Account username and password. It is your responsibility to safeguard this information and prevent unauthorized access. You will be held liable for any activity that occurs under your Account.
 
Maintaining Account Confidentiality: As the Account holder, you should refrain from sharing your username and password with anyone else. If you suspect any unauthorized access or activity on your Account, it is essential to notify the company immediately through the support service on the application for a prompt resolution.
 
By adhering to these guidelines, you can ensure a smooth and uninterrupted experience on the Company Platform. Protecting your personal information and privacy is of utmost importance to us.
 
It is worth noting that the Account creation and management process aims to provide a seamless and personalized user experience. Maintaining up-to-date Account information enables the Blue platform to offer tailored services and communicate effectively.
 

8. Blue Platform Usage Guidelines: Compliance and User Responsibility

The Blue platform is designed for individuals capable of entering into legally binding contracts under applicable law. Corporate customization may be available in the future. It is essential to note the following guidelines regarding platform usage:
 
Age Restrictions: The Blue Platform is not intended for use by individuals under 18, except when accompanied by an adult or the user themselves is the account holder. Users under the age of 18 are expressly prohibited from utilizing the service.
 
Non-Transferability of Account: Users cannot transfer their Account to any other person or entity. Account management and access are the responsibility of the individual user who created the account.
 
Compliance with Applicable Laws: Users must comply with all applicable laws and regulations while using the Blue Platform. The platform should only be used for lawful purposes defined by the relevant legal framework.
 
Consideration of Others: Users must refrain from using the Blue Platform in a manner that causes inconvenience or harm to any.
 

9. Use of the Services.

By using Blue Platform and Services, the user accepts the risks and agrees that Blue is not liable for the acts of users, Drivers, or any other third parties.
 
Blue disclaims any liability arising from the unauthorized use of the user-registered account. If the user suspects any unauthorized use or breach of security, promptly notify Blue support team.
 

10. Ownership and Restrictions: Blue Platform’s Rights and Trademarks”

Blue Platform and all its rights belong to it. These Terms & Conditions do not grant any rights to use the Blue’s names, logos, products, trademarks, or service marks.
 

11. Guidelines for Conduct as a User of Blue Platform and Services

As a Blue Platform and Services user, it is crucial to maintain appropriate conduct. This includes adhering to the following guidelines:
 
Identity: Refrain from assuming another person’s identity.
 
Legal Compliance: Avoid violating any laws or regulations while using the platform.
 
False or Harmful Content: Do not spread incorrect or objectionable information.
 
Substance Use: Refrain from consuming drugs or alcohol while riding or using the platform.
 
Intellectual Property: Do not infringe on the intellectual property rights of others.
 
Malicious Code: Avoid transmitting malicious code through the platform.
 
Unauthorized Modifications: Do not modify the platform without express authorization.
 
Automated Devices: Refrain from utilizing automatic devices to scrape the platform.
 
External Links: Do not link to other websites without proper authorization.
 
Account Transfer: Do not transfer or sell your account.
 
Discrimination and Harassment: Avoid engaging in discriminatory or harassing behavior towards others or encouraging such behavior.
 
Failure to comply with these guidelines may result in the driver refusing service.
 

12. Transparent Fares with Blue: Your Estimated Price, Adjusted for Your Journey

Picking the right ride-hailing service can sometimes leave us uncertain about the final fare. With Blue, we aim for clarity and transparency!  Our service ensures that when a user selects his destination, the fare provided will be an estimation derived from a service provider based on distance and traffic conditions, including rush hours and realistic and normal traffic congestion. While this fare will usually remain unchanged, factors such as a route change, a new destination, severe congestion or sudden road traffic closures may result in additional charges for extra travel distance or time.
 
Reliable Fare Estimates: The fare displayed when booking will generally be the price the user pays. A fee for Extra Travel Distance may apply if the user changes the route or destination, and an additional charge for Extra Travel Minutes may be applied. We believe in full transparency to give users peace of mind when planning your journey.
 
Comprehensive Fares for Peak Hours and Traffic Congestion: We understand that riding can be unpredictable, especially during rush hours and realistic and normal traffic congestion.  Blue considers all these factors when calculating the fare. However, please note that additional fees may apply in the unexpected cases such as severe congestion or sudden road traffic closures.
 
Price Adjustment and Quick Updates: All transaction costs, taxes, fees, and charges from the third-party provider will be included in the trip’s total price. If additional stops or changes to the destination or route are made based on the user’s demand, the price will be adjusted accordingly and the pertinent details displayed on the trip receipt. At Blue, we prioritize providing a fair and reliable service. Occasionally, we may need to update our rates to meet market needs and ensure drivers receive fair compensation. However, any price adjustments will always be transparently displayed to our users. Rest assured, our commitment to providing the best value for users’ money is unwavering.
 
Route Adherence and Complaints: In the event that a driver takes a longer route without user’s permission, the user can file a complaint through the “Help” section in the app. Our support team will thoroughly review the matter and take appropriate action. Nevertheless, to avoid such issues, we recommend that the user monitors the route provided in the app during the trip and ensure that the driver adheres to the suggested path.
 

13. Payments and Support with Blue: Your Hassle-Free trip

When it comes to charges, convenience and flexibility are key. With Blue, we’ve streamlined the payment process for your ease and comfort. Whether you prefer digital payments or cash, we offer various options to suit your needs. Additionally, our dedicated support center and mobile app ensure that any service issues you encounter can be quickly resolved.

Full Payment Flexibility: We offer Full Payment Flexibility at Blue, meaning you can choose how you want to pay for your trip. You can easily find the applicable rate for your trip on our mobile app and select the payment option that suits you best. We accept multiple payment methods, including cash and digital payments. The Blue Wallet is also available, which can be credited through debit or credit cards, as well as Apple Pay or. With our hassle-free payment experience, you can enjoy your trip without worries.
 
Cash Payments: If digital payment is not available, don’t worry! Blue still has you covered. You can pay the fare in cash at the end of your trip based on the total bill displayed. This option ensures that you can conveniently settle your payment and continue your trip without any complications. In such case: (a) The user will directly pay the driver instead of the User Application. (b) The user will be solely responsible for paying the Cash Fare and getting the correct change, if applicable.

Utilize our user-friendly mobile app or reach out to our support team, available at Blue office working hours. Rest assured, we are committed to ensuring your satisfaction and resolving the concerns you may have.

14. Non-Refundable Wallet Credits with No Expiry Date

Please note that at Blue, credits are non-refundable once the user adds credits to their wallet using a credit or debit card or through Apple Pay . However, it’s important to note that Blue does not impose an expiration date on the wallet credits.
 

15. Disclaimer and User Responsibilities: Understanding Blue’s Platform and Services

We at Blue strive to provide a reliable and convenient platform for our users. However, it’s important to note that our services and platform are provided on an “as is” and “as available” basis. We want to ensure transparency by informing you that any representations or warranties not expressly mentioned in these terms are disclaimed.
 
This includes unqualified guarantees of merchantability, suitability for a particular purpose, and non-infringement. We cannot guarantee uninterrupted or error-free experiences on the Blue platform.
 
Please read through the following information regarding the limitations and responsibilities associated with utilizing Blue’s platform and services:
 
No Guarantee of Reliability and Timeliness: While we do our best to maintain a reliable and timely service, Blue cannot make any representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of our platform or services. We acknowledge occasional interruptions, technical issues, or unforeseen circumstances may arise.
 
No Guarantee of Driver Quality or Safety: Blue does not guarantee the quality, suitability, safety, or ability of the drivers who provide transportation services through our platform. We strive to look for reputable and qualified service providers, but it is essential to understand that we cannot personally screen or monitor every individual involved. As a user, exercising caution and using your judgment when engaging with the drivers is necessary.
 
Assumption of Risk: Using the Blue platform and services, you acknowledge and agree that the entire risk associated with using the platform and any services requested rests solely with you. This means that you are responsible for any consequences that may arise from utilizing Blue, to the maximum extent permitted under applicable law.
 
Limitations of Liability: Under no circumstances shall Blue, its affiliates, directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of funds, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Blue platform or services.

Limited Liability for Damages: Blue shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages. This includes lost profits, lost data, personal injury, or property damage resulting from the use of the Blue platform or services. Recognizing and accepting this limitation when engaging with the platform is essential.
 
Limitation of Blue’s Liability: Blue shall not be liable for any damages, liability, or losses arising from your use of or reliance on its platform or services. This includes any inability to access or use the platform and any transactions or relationships between you and a driver. Blue’s total liability for all damages, losses, and causes of action shall not exceed the value of the agreed taxi service fare.
 
Missed Appointments and Alternative Arrangements: Blue and drivers are not liable for any compensation or losses incurred if you miss a flight, appointment, meeting, function, or commitment. You are responsible for making alternate arrangements if the driver fails to reach the pickup location on time or encounters unforeseen delays.
 
Force Majeure Events: Blue or its drivers will not be held liable for any delay or failure in performing their duties and obligations caused by a Force Majeure event. Such events include natural disasters, accidents, or circumstances beyond their control.
 
Driver Conduct and Complaints: Blue is not responsible for any illegal actions the drivers commit. If you have any complaints about a driver, we strongly recommend that you report them to Blue for appropriate action.
 
Loss of Communication and Information: Blue is not responsible for any loss of communication or information related to its services or programs. The user is accountable for ensuring the accuracy of their contact information. Blue will send all updates and notifications to the mobile number and email ID registered in its platform.
 
Booking Confirmation Errors: Users must immediately report any errors in the information regarding their booking confirmation. Timely reporting of such errors will allow Blue to address and rectify the issue effectively.
 
Pet Transportation Policy:  To ensure a smooth experience, we kindly ask that you inform the driver in advance if you intend to travel with a pet via the in-app messaging or call feature once your ride is confirmed. Drivers may accept or decline the ride based on their sensitivity, comfort and vehicle suitability. Additionally, please secure your pets in appropriate carriers to ensure cleanliness and safety if the ride is accepted by the driver.
 
Driver Assistance with Personal Items: Please note that while drivers are responsible for transportation, any assistance with personal items, such as lifting or carrying objects, is at the driver’s discretion. Drivers are not obligated to provide this type of help, and it should be understood as a personal favour rather than a service included with your ride.

Blue encourages users to prioritize their belongings by taking full responsibility for them. Our platform strives to provide a reliable and efficient service, but users must acknowledge the responsibility of using our services. Lost Belongings: At Blue, we understand that occasionally items may be left behind in the vehicles. In such cases, we make a “best-effort” attempt to locate them. However, it is vital to note that wBlue is not liable for any lost belongings. We strongly advise users to double-check their belongings before exiting the vehicle to minimize inconvenience or loss.
 
Driver and Vehicle Identification: We urge users to file a complaint if they notice that the driver, the vehicle, or the plate number does not match the details provided in the driver’s profile in the app when the trip is accepted by the driver. Ensuring the accuracy of this information is critical for rider safety and trust. Complaints of this nature will be thoroughly investigated, and necessary actions will be taken as per our driver agreement and policies.
 
Reporting Service-Related Issues: In the rare event of experiencing any service-related issues, we urge users to report them promptly. Our policy necessitates reporting all such matters within seven working days of using the service. If a service issue arises, our liability is limited to the trip value. This includes essential service messages to update you about the latest deals, benefits, offers, and promotions. The laws of the Territory govern the terms and conditions set forth by Blue. We aim to ensure clarity and understanding regarding any disputes or claims that may arise. If any disputes or lawsuits, including non-contractual ones, occur, we request that you notify Blue within seven days from the event date. Please take the time to familiarize yourself with and carefully read the following Blue Wallet terms and use associated with Blue’s terms of use.
 
Before accessing or utilizing the Services, it is essential that you thoroughly understand and accept these Terms of Use. All interactions with the Application and Services, including the processing, storing, transferring, and sharing of personal data, confidentiality, intellectual property rights, engagements with third parties, and indemnification, are governed by these Terms within the Estonia.
 
Should you disagree with Blue Wallet or the General Terms of Use applicable to the Application and Services in general, you are strongly advised to stop using the Application and refrain from accessing or utilizing the Services. However, should you continue accessing the Application and engaging with the Services, you affirm your consent and binding agreement to adhere to the below terms.
 
These terms solely pertain to the usage, loading, and redemption of Blue Wallet as a payment method, as well as to resolving underpayment issues and transferring credit between riders. It is important to note that these Terms do not apply to transactions conducted using alternative payment methods, as the General Terms of Use govern those transactions.
 
2. Binding Agreement: Terms of use for Utilizing Blue Wallet Services
 
This legally binding agreement, titled “Terms of use,” is established between you as a user “rider” and Blue, a corporation duly established under the jurisdiction of Estonia, having a service called “Blue” and “Blue wallet” that governs all payments related issues under Blue service. Before downloading, installing, or using the Application or accessing and utilizing the Services, including the Blue wallet, please carefully read, comprehend, and accept these Terms of Use.
 
It is important to note that when selecting Blue wallet as a payment method for a Transaction, Blue will be responsible for fulfilling any payment obligation to Third-Party Providers on your behalf, represented by drivers working under the supervision of limousine companies or sponsored by them. When completing the Transaction, this will be done using the available balance reflected in your Blue Wallet account. Furthermore, it is essential to acknowledge that using Blue wallet as a payment method will result in a deduction from your Blue wallet balance upon completion of the Transaction.
 
3. Usage Requirements: Active and Valid Account Required for the Blue Wallet
 
To utilize the Blue wallet, it is essential to have an active and valid Account. Please note that Blue wallet can only be used as a payment method within the Application for Transactions conducted within the specified Territory. When you choose to use Blue wallet as your payment method, the total cost of the Transaction will include the Transaction cost itself along with any applicable taxes, fees, or charges imposed by the Third-Party Provider. It’s important to highlight that Blue does not impose any costs or fees for your Account on the usage of Blue wallet.
 
To stay informed about your Transactions, you can conveniently access and review them by logging into your Account through the Application. The Blue wallet balance displayed in the Application serves as conclusive evidence of your current Blue wallet balance.
 
4. Convenient Ways to Load Your Blue Wallet
 
To ensure flexibility and ease of use, you have the option to load your Blue wallet using various payment methods. These digital methods include (a) Debit card, (b) Credit card, (c) Apple Pay, (d) Google Pay, and (e) Any other payment method periodically provided by Blue through the Application.
 
To add credit to your Blue wallet balance before initiating a service, access the “Wallet Tap” within the Application and click “Add credit”. By following the guidelines outlined in the General Terms of Use, Blue may require you to add a secondary payment method to utilize Blue wallet as a payment method for Transactions conducted through the Application.
 
 5. Adding Payment Methods to Credit Blue Wallet
 
You can conveniently add alternative payment methods to expand the options for crediting your Blue wallet. Here’s how:
 
1-Open the Application and navigate to the “Wallet” section.
 
2-Select “Payment Method” to initiate the process.
 
3-Add the desired payment method to your Account before your next Transaction.
 
By choosing a specific Payment Method, you acknowledge and agree to the terms of service provided by Blue’s payment processing partners and the financial institution or payment services provider associated with your selected Payment Method. Additionally, when using your chosen payment method, you accept responsibility for any related costs or charges imposed by Blue, payment processing partners, or financial institutions.
 
Please note that Blue reserves the right, at its sole discretion, to decline a request to credit the Blue wallet. This may occur, for example, if such credit would result in exceeding the permitted value as dictated by prevailing laws and regulations. Additionally, Blue reserves the right to inform you, at any time (including during or after a Transaction), through the Application if there are any limitations on the amount of credit that can be applied to the Blue wallet or if you have reached the maximum number of the permitted number of loading credits within a specified period.
 
6. Handling Negative Balances and Deductions in Blue Wallet
 
Knowing that a negative balance may occur in your Blue wallet in certain situations is essential. Blue allows for a negative balance to cover fees such as cancellation fees, waiting time fees, or any other fees that may be imposed. When these expenses are deducted from your wallet balance, they will be reflected as a negative balance in your Account.
 
To address this negative balance, Blue automatically collects the outstanding amount by adding it to the payable balance when you top up your Blue wallet or after your next Transaction via the Application. The maximum limit for the negative balance you can accumulate on your Account will be notified through the Application, including the payment phase. It is worth noting that once this limit is reached, you cannot book any further Services via the Application until the negative balance is cleared.
 
When the negative balance is added to your next Transaction, the total amount payable will comprise the total cost of your Transaction plus the outstanding negative balance as reflected in your Account. To ensure proper collection of the owed sums, Blue will notify the relevant Third-Party Provider via the Driver Application regarding the amount of negative balance owed by you to Blue after your Transaction.
 
To clarify, Blue does not charge any additional fees, interest, consideration, or administration fees on any negative balance accrued on your Account, except for the top-up payment.
 
7. Flexible Payment Options: Cash to Wallet Conversion
 
Blue is pleased to offer riders the convenience of changing their payment method from cash to wallet before and during the ride. This feature allows for a seamless transition and ensures a hassle-free experience. However, changing the payment method from wallet to cash before and during a ride is not applicable. We encourage riders to make the necessary arrangements before the start of the trip to avoid any inconvenience.
 
 8. Non-Refundable Wallet Credits.
 
Please note that at Blue, credits are non-refundable once the users add credits to their wallet using a credit or debit card or through Apple Pay, Google Pay, or any digital payment method.
 
In exceptional cases where a user requests a refund of wallet credits, the amount will be refunded in cash and must be collected in person at our office.

Unlike other digital wallets with expiration dates, the Blue Wallet is a permanent and reliable solution that offers infinite validity. With no expiration date, users have unrestricted access to their accounts for daily and long-term transactions. By our commitment to ensuring your utmost security, preventing fraudulent activities, and complying with laws and regulations, we will request specific information from you during the account opening process. This information confirms your identity, enables you to establish and maintain an account, and utilizes the Blue wallet.
 
Additionally, we may periodically require you to update and verify the information provided. This is an additional measure to ensure that only you, as the authorized user, can access your account and Blue wallet. Failure to comply with these information requests or verification steps may delay, suspend, or restrict your access to the Blue wallet.
 
By adhering to these security measures and cooperating with information requests, we collectively contribute to maintaining a secure and trustworthy financial environment.
 
11. Blue Wallet Service Scope and Regional Limitations

One of the fundamental operational principles of the Blue Wallet is its confinement to a defined Territory. Users must know that the Blue Wallet is exclusively intended for use within this regional boundary. Attempting to utilize the Blue Wallet for transactions outside the designated Territory is strictly prohibited.
 
This regional restriction is in place to ensure compliance with local regulations and to maintain the integrity of the Blue Wallet’s operations. Users need to respect these territorial limitations to uphold the security and reliability of the wallet service.

It is essential to understand that determining any amount to be reversed, returned, or charged back is solely the responsibility of the financial institution or payment services provider responsible for the designated Payment Method linked to your Application. Blue must adhere to the instructions provided by this financial institution or payment service provider.
 
14. Responsibilities and Notifications Regarding Fraudulent Activity and Theft of Blue Wallet
 
 Safeguarding the Blue wallet from fraudulent activity and theft is of utmost importance. This section outlines your responsibilities in notifying Blue promptly in case of such incidents. Additionally, it clarifies Blue’s role in handling unauthorized use of the wallet and its ability to take action to protect its users.
 
1. Immediate Notification Requirement: As the user, you agree to notify Blue immediately upon becoming aware of any fraudulent activity or theft involving your Blue wallet. This prompt notification is essential to enable quick action to protect your account and mitigate any potential damages.
 
2. Channel for Notifications: Notifications regarding fraudulent activity or theft should be made to Blue through the Blue Application. Utilizing this channel ensures that your issue is promptly addressed and appropriate actions are taken.
 
3. Responsibility for Informing Financial Institution or Payment Services Provider: You are solely responsible for promptly informing your financial institution or payment services provider about any fraud associated with your payment card. This step helps protect your financial interests and facilitates necessary investigations and resolutions.
 
4. Unauthorized Use Disclaimer: You acknowledge and agree that Blue is not liable for any unauthorized use of the Blue wallet. Maintaining your wallet’s security and taking appropriate measures to prevent unauthorized access or use is crucial.
 
5. Blue’s Right to Suspend or Void Transactions or Services: In its sole and absolute discretion, Blue reserves the right to suspend or void any transaction or service related to the Bluewallet. This action may be taken if Blue has reasonable suspicion that the wallet has been fraudulently obtained or used, unlawfully used, involved in illegal activities, or if you have violated the terms and conditions outlined.
 
Ensuring the security of the Blue wallet requires active participation from both you as the user and Blue as the service provider. Prompt notification of any fraudulent activity or theft and responsible communication with your financial institution or payment services provider is essential. While Blue is not responsible for unauthorized use, it retains the right to take necessary actions in the presence of fraudulent or unlawful activities, safeguarding the system’s overall integrity and protecting its users.
 
15. The Application and Services: General Provisions on Ownership and Intellectual Property
 
The General Terms’ provisions regarding the Application and Services and Intellectual Property ownership will equally apply to these Terms.
 
16. Priority of Terms: Blue Wallet
 
In cases where there is a conflict between these specific Terms for Blue Wallet and the General Terms, these Terms shall take precedence.
 
18. Blue’s Wallet Terms Modification Policy
 
Blue reserves the right to amend any of these Terms at its discretion, with or without prior notice to you, in compliance with relevant legal requirements.
 
The most recent version of the terms will become effective when Blue posts the updated Terms. Your continued use of any aspect of Blue Wallet following such publication signifies your acceptance of the revised Terms. If any provision in these Terms is found invalid, void, or unenforceable, it shall be considered separately. It will not impact the validity and enforceability of the remaining provisions.
